Facts
Mark Poore (plaintiff) was employed by Peterbilt of Bristol, L.L.C. (Peterbilt) (defendant). On January 23, 2010, Peterbilt asked Poore to submit a health-insurance questionnaire regarding Poore’s family medical history. Poore disclosed that his wife had been diagnosed with multiple sclerosis. A few days later, Peterbilt terminated Poore’s employment, despite the fact that Peterbilt had recently informed Poore that he was performing well. Poore sued Peterbilt in district court, alleging that Poore had been discriminated against based on genetic information, in violation of the Genetic Information Nondiscrimination Act (GINA), 122 Stat. 881. Peterbilt moved to dismiss the complaint based on failure to state a claim.
