Facts
Jerry Downey (plaintiff) was sued by Porters Building Centers, Inc. (Porters) (defendant), his former employer, in connection with a business dispute. Downey counterclaimed for trespass to chattels, alleging that Porters employees had used a company computer to access Downey’s personal Gmail account. Porters moved for summary judgment, arguing that emails are not chattel.
