Facts
Edward Pottgen (plaintiff) had reached the age of 19 before his senior year of high school and was prohibited by The Missouri State High School Activities Association (MSHSAA) (defendant) from being eligible to play on his school’s baseball team. Pottgen had been forced to repeat two years in early elementary school due to a later-diagnosed learning disability. Pottgen petitioned the MSHSAA for a disability waiver of the age rule but was denied. Pottgen brought suit against the MSHSAA in U.S. District Court alleging violations of the federal Rehabilitation Act, the Americans with Disabilities Act (ADA), and seeking an injunction barring the rule from applying to him. The district court granted the injunction and the MSHSAA appealed.
