Facts
Bean Dredging Company (defendant) negligently caused damage to Texaco’s natural-gas pipeline in the Calcasieu River, which rendered Texaco incapable of fulfilling its contract to supply natural gas to PPG Industries Inc. (plaintiff) so that PPG could operate its manufacturing plant. As a result, PPG had to find fuel from another supplier at an increased cost. PPG sued Bean in a state court in Louisiana to recover the increased cost to get gas. Bean filed an exception of no cause and argued that Louisiana never recognized the right to recover for negligent interference with contractual relations. The trial court agreed and dismissed the case in favor of Bean. PPG appealed, and the appellate court affirmed the trial court decision. PPG appealed.
