Facts
Good Land Company (Good Land) conveyed a tract of land to J.C. Trout, reserving a 9/10 mineral interest. Trout then conveyed the land to Lizzie Allen (plaintiff). Good Land leased its reserved rights to a third party oil company, which in turn assigned the lease to Skelly Oil Company (Skelly). Skelly dug a well on the land, produced oil, and sold the oil to Prairie Oil & Gas Co. (Prairie) (defendant). Allen objected to Skelly’s extracting oil from the property. Allen demanded that Prairie give to her 1/10 of all oil produced from the property that Skelly had sold to Prairie. Prairie refused. Allen claimed that Skelly’s lease was void as to her because the parties to the lease had not received her consent prior to entering into the lease. The trial court ruled for Prairie, and Allen appealed.
