Facts
In Nepal, uterus prolapse and related women’s reproductive health challenges were caused by lack of nutritious food during pregnancy; discrimination against women; lack of awareness of reproductive health; and lack of access to effective medical care, medical practitioners, and medical equipment. Prakash Mani Sharma (plaintiff), on behalf of herself and the public interest group Pro-Public, brought a lawsuit against Nepal (defendant) arguing that the government’s failure to address the disastrous health effects of uterus prolapse on women in Nepal constituted a violation of their right to life as guaranteed by the Nepalese constitution. Sharma asked the Nepal Supreme Court to order the government to draft a bill to address women’s reproductive health, to submit the bill to parliament, and to initiate public-awareness programs through national media to address the problem of uterus prolapse.
