Facts
Kimberly Parmenter Price (plaintiff) was riding on a motorcycle driven by Duane Price (defendant). The motorcycle collided with a truck, injuring Kimberly. Six months later, Kimberly and Duane married. Kimberly then sued both the driver of the truck and Duane for negligence. The truck driver settled with Kimberly. Duane moved for summary judgment, claiming that Kimberly’s suit was barred under the doctrine of spousal immunity. The trial court granted summary judgment. Kimberly appealed, and the court of appeals affirmed the judgment. Kimberly appealed.
