Facts
While Tammie Priselac (plaintiff) lived in Wilmington, North Carolina, her water was supplied by the Cape Fear Public Utility Authority (the authority). The authority drew its water from the Cape Fear River. Priselac filed suit on behalf of herself and a purported class of similarly situated persons against Chemours Company (defendant), alleging that Chemours’s operations at a nearby work site had released perfluorinated chemicals into the Cape Fear River and thus contaminated the drinking water. Priselac asserted multiple claims against Chemours based on the alleged contamination, one of which was a private-nuisance claim. She alleged that Chemours’s conduct exposed her to an increased risk of illness and disease and created a need for diagnostic testing. Additionally, Priselac alleged that Chemours’s conduct caused her angst and the inconvenience of needing to install water-filtration systems in her home. Chemours moved to dismiss the private-nuisance claim, among others, alleging that the claim was not viable.
