Facts
Procter and Gamble Company (P&G) (plaintiff) opposed Bankers Trust in a civil lawsuit. The parties agreed to a protective order allowing discovery material to be filed under seal if either party, not the court, believed it disclosed trade secrets or other related confidential information. A publication of McGraw-Hill Companies, Inc. (McGraw-Hill) (defendant), Business Week, acquired the sealed discovery from a confidential source. The district court entered permanent and temporary orders prohibiting the publication of the sealed discovery because of irreparable harm. The court order was faxed to Business Week. Business Week followed the order and did not publish the information but filed an expedited appeal of the injunction.
