Facts
Franchisor Pronuptia de Paris GmbH (Pronuptia) (plaintiff) contracted with franchisees to open stores that sold wedding dresses under the Pronuptia name. Schillgalis (defendant) was a franchisee and owner of a store in Hamburg that operated under the name Pronuptia de Paris. Schillgalis argued royalties were not due to Pronuptia, because the franchise agreement violated Article 101(1) of the Treaty on the Functioning of the European Union (TFEU) for restricting competition and was therefore void. After proceeding in German courts, the European Court of Justice was asked to answer the issue of restrictions on competition under TFEU.
