Facts
Jean-Pierre Bemba Gombo (Bemba) (defendant) was accused of war crimes and crimes against humanity committed in the Central African Republic by his troops. Bemba was apprehended and tried by the International Criminal Court (ICC). In confirming Bemba’s charges, the pretrial chamber of the ICC addressed whether the intent element of ICC Article 30 could be proved by showing dolus eventualis.
