Facts
The prosecutor of the International Criminal Court (ICC) charged Thomas Lubanga Dyilo (Lubanga) (defendant) with war crimes committed during a conflict in the Congolese region of Ituri. The trial chamber of the ICC found Lubanga guilty, based on evidence that Lubanga and others knowingly participated in a common plan entailing the risk that, under the circumstances prevailing in Ituri at the time, and in the ordinary course of events, the plan’s implementation would almost certainly require committing the war crimes of recruiting, enlisting, or conscripting child soldiers under the age of 15. Lubanga appealed to the ICC’s appeals chamber.
