Facts
Prudential Insurance Company (Prudential) (plaintiff) is an insurance company incorporated in New Jersey. It conducts business in South Carolina. South Carolina imposes a tax on foreign insurance companies doing business within South Carolina, regardless of the interstate or local nature of the business. Prudential challenged this tax, arguing that it violated the dormant Commerce Clause.
