New Jersey Superior Court, Appellate Division
521 A.2d 1313 (1987)
- Written by Sean Carroll, JD
Facts
Donna and Charles Graziano (defendants) agreed to sell a condominium to J. Daniel Pruitt (plaintiff). The Grazianos breached the contract, and Pruitt brought suit seeking specific performance of the contract. The trial court granted summary judgment to Pruitt and awarded specific performance. The Grazianos appealed, arguing that Pruitt did not present any evidence of the condominium’s uniqueness. The condominium was one of 250 in a large complex.
