Facts
Publications International, Ltd. (Publications International) (plaintiff) and Landoll, Inc. (Landoll) (defendant) are both publishers of cookbooks. Publications International claimed that its books had a distinctive trade dress and that Landoll had copied this trade dress. Landoll produced cookbooks with pages of the same size and gilded edges as those of Publications International’s books as well as the same oilcloth covers. The district court granted Landoll’s motion for summary judgment, and Publications International appealed.
