Facts
Under a contract between Puerto Rico Maritime Shipping Authority (PRMSA) (plaintiff) and Star Lines, Ltd. (defendant), Star Lines was responsible for servicing and booking the cargo for a ship owned by PRMSA. PRMSA terminated the contract, and a dispute arose between the parties. The parties submitted the dispute to arbitration, asserting crossclaims against one another. Some claims were contested, and for others, liability was admitted and only the amount of damages was contested. The arbitral panel issued a partial award in favor of PRMSA on PRMSA’s claims against Star Lines. The partial award only awarded PRMSA damages up to the amount that Star Lines had admitted liability on PRMSA’s claim for freight monies, and it ordered Star Lines to pay over any freight monies that were or might come into Star Line’s possession. The partial award did not resolve the final amount due for freight monies. PRMSA filed an action in federal district court to confirm the partial award.
