Facts
Quaker State Oil Refining Corporation (Quaker State) (plaintiff) sued Kooltone, Inc. (defendant) for trademark infringement based on Kooltone’s imitation of the cans in which Quaker State sold its brand of motor oil. The jury returned a verdict in favor of Quaker State, finding that Kooltone’s infringement was deliberate and willful, and awarded various damages. The district judge then granted Quaker State’s motion for attorney’s fees and awarded Quaker State $50,000. Kooltone appealed.
