Facts
Radford (plaintiff) owned a home adjacent to a garden and plot of land. Radford sold the plot of land to De Froberville (defendant), who planned to build on the plot, for 6,500 pounds. As part of the transaction, De Froberville promised to build a wall to separate the plot from the remainder of Radford’s land. De Froberville did not build the wall. Radford brought suit, seeking 3,400 pounds, which represented the cost of building the wall. The lack of the wall did not diminish the market value of Radford’s property.
