Facts
Six members of Congress (plaintiffs) filed suit in federal district court against the Secretary of the Treasury and the Director of the Office of Management and Budget to challenge the constitutionality of the Line Item Veto Act. The district court denied the defendants’ motion to dismiss for lack of standing and ripeness and declared the Act unconstitutional. The defendants directly petitioned the United States Supreme Court for review.
