Facts
The Central Pension Fund of the International Union of Operating Engineers (the fund) (plaintiff) sued Ray Haluch Gravel Co. (RH Gravel) (defendant) on behalf of RH Gravel employees to recover certain pension compensation. A trial was held, and on June 17, 2011, the trial court awarded the fund $17,000 in unpaid pension compensation. On July 25, 2011, the trial court awarded the fund $35,000 in attorney’s fees. On August 15, 2011, the fund appealed both decisions. RH Gravel filed a motion to dismiss the appeal as to the June 17 judgment, arguing that the 30-day appeal period for that judgment had passed. The court of appeals denied RH Gravel’s motion to dismiss, finding that the two judgments were part of one final judgment entered on July 25. Viewed this way, the fund’s appeal was timely. The United States Supreme Court granted certiorari to determine whether the June 17 judgment was final for appellate purposes. The fund argued that its right to attorney’s fees came from its contracts with RH Gravel and thus were not collateral but part of the merits of its compensation claim.
