Facts
William Walters (defendant) associated with two other lawyers under the name Law Offices of MacDonald, Brunsell & Walters (firm) (defendant). In 1969, Fred Redman (plaintiff) entered into a retainer agreement with the firm to represent Redman in litigation. Although court papers listed the firm as Redman’s attorneys of record in that litigation, only Brunsell had any actual knowledge of Redman’s case. Walters himself never met Redman and never heard of Redman’s litigation. Walters left the firm in 1970. In 1974, Redman’s case was dismissed for failure to bring it to trial within five years. Redman sued the firm and Walters for negligent representation. Walters moved for summary judgment dismissing him from the action. After the trial court granted Walters’s motion, Redman appealed to the California Court of Appeal.
