Facts
Plaintiff brought this action based on an accident that caused the death of the plaintiff’s intestate. Plaintiff claimed that the defendant’s negligence caused the death. Plaintiff sought to introduce into evidence the defendant’s statements to the coroner about the circumstances and cause of the accident. The defendant was not present at the time of the accident. The trial court admitted the evidence as an admission by a party opponent. Defendant appealed.
