Facts
D (defendant) was charged with witness intimidation. D was Muslim and appeared in court wearing a burq’a and a niqaab. A niqaab was a face covering. D requested that she be allowed to wear the niqaab during court proceedings and argued that the European Convention for the Protection of Human Rights and Fundamental Freedoms allowed her to do so. There was no indication that D was insincere in her belief that she should keep her face covered.
