Facts
Hands (defendant) was indicted for committing larceny from an “automatic box.” To operate an “automatic box” an individual inserted a penny into it, pushed a knob, and a cigarette was ejected and presented to the payor. Hands inserted a piece of metal to represent a penny, but which had no value, in order to obtain a cigarette. Hands was convicted and he appealed.
