Facts
Ferdinand Keyn (defendant) was the captain of the German vessel the Franconia. While navigating less than three miles off the shore of Great Britain, the Franconia struck a British vessel, killing a woman. The Franconia was not stopping at port in Great Britain but merely passing by when the accident occurred. Great Britain (plaintiff) charged Keyn with manslaughter. The trial court convicted Keyn. Keyn appealed.
