Facts
After his Oregon teaching license expired, Raphael Reguero (defendant) applied to the Teacher Standards and Practices Commission (TSPC) (plaintiff) to reinstate his license. TSPC held a hearing to determine whether Reguero was fit to serve as a teacher. At the hearing, TSPC introduced hearsay testimony that Reguero had engaged in inappropriate sexual conduct with two of his sixth-grade pupils, Michelle and Leasa. The hearsay testimony was from a school counselor, a deputy district attorney, and a police officer, each of whom had interviewed Michelle and Leasa. Neither Michelle nor Leasa testified at the hearing. TSPC denied Reguero’s application to reinstate his teaching license. The court of appeals affirmed. Reguero appealed to the Oregon Supreme Court.
