Facts
A subdivision's restrictive covenants gave the homeowner's association discretionary power to grant or deny a homeowner's application for a variance from the covenants. The association denied Randall and Orna Reiner's (plaintiffs') request for a variance from the restriction prohibiting asphalt roofing. The Reiners sued the association, as well as Clifford Ehrlich and other individuals (codefendants), for a declaratory judgment and relief from all subdivision-wide architectural restrictions. The trial court dismissed the individuals as parties and entered summary judgment for the association. The Reiners appealed to the Maryland Court of Special Appeals.
