Facts
Albert Reinfeld (plaintiff) filed discovery with Guinness PLC, requesting certain documents. Guinness asserted the work-product doctrine and the attorney-client privilege. Reinfeld argued that Guinness had disclosed the documents to the English government, thus waiving the privileges. The magistrate judge found that Guinness’s disclosure to the English government had waived the attorney-client privilege but not the work-product privilege.
