Facts
MacDonald (defendant) was pregnant with her unborn daughter, Remy (plaintiff), when she negligently caused a car accident. Remy was born prematurely as a result of the accident and suffered lingering medical conditions. Remy brought a negligence claim against MacDonald for her prenatal injuries. The trial court found that MacDonald owed no duty of care to her unborn child, and granted summary judgment in favor of MacDonald.
