Facts

A group of labor unions (plaintiffs) filed a petition with the United States International Trade Commission (ITC) and sought relief under Section 201 of the Trade Act of 1974. The labor unions asserted that certain motor vehicles and parts were being imported in such increased amounts that the imports were a substantial cause of serious injury to the United States automobile-manufacturing industry. The petition was filed in 1980, and the economy was generally suffering from an overall recession. The ITC’s investigation revealed that the United States automobile-manufacturing industry did experience a decrease in demand. However, there were a number of causes to the decrease in demand, including inflation, unemployment, rising interest rates, and higher energy costs. The ITC assessed the labor unions’ claims.
