Facts
The Republic of Kazakhstan (Kazakhstan) (plaintiff) and Biedermann International (Biedermann) (defendant) were participating in an arbitration before the Arbitration Institute of the Stockholm Chamber of Commerce when a discovery dispute arose. Kazakhstan filed an action in United States district court to compel the deposition and further discovery from a third-party witness related to Biedermann. Kazakhstan relied on 28 U.S.C. § 1782 as support for the court’s authority to compel discovery. The district court ordered the requested discovery. The district court also denied Biedermann’s request for reconsideration and its motion for an emergency stay of discovery. Biederman made an expedited appeal.
