Facts
The United States seized 600 units of Nue-Ovo, claiming that the product was misbranded because it falsely claimed that it aided arthritis symptoms. Research Laboratories, Inc. (plaintiff), the manufacturer of the product, sued to appeal the seizure. The court ruled in the government’s favor, and Research appealed. Research argued that Nue-Ovo’s arthritis claims were merely a statement of opinion that could not be regulated.
