Facts
In 1973, highway construction was begun in the traditional territory of the Yanomami Indians in Brazil. The construction attracted settlers who brought diseases that killed a considerable number of Yanomami. Many Yanomami left their villages and were forced into poverty or prostitution. In 1976, various valuable metals were discovered in the area, which led to violence between the miners and the Yanomami people. The executive director of the Indian Law Resource Center and others (plaintiffs) brought a petition against Brazil (defendant), alleging violations of the Yanomami Indians’ human rights under the American Declaration of the Rights and Duties of Man (the declaration).
