Facts
The Restaurant Opportunities Center of New York (ROCNY) was an organization that provided social advocacy, legal services, and job-support services for restaurant workers in New York. At one point, ROCNY represented employees in their claims of employment discrimination. In that capacity, ROCNY attempted to negotiate settlement agreements with employers and engaged in picketing and hand-billing outside of employers’ restaurants to encourage settlement of employees’ legal claims. ROCNY negotiated a proposed settlement agreement with one restaurant, Daniel, containing an arbitration clause as a means of resolving alleged contract violations. ROCNY also distributed hand bills and held picket signs in front of Daniel alleging discriminatory practices. The National Labor Relations Board was called on to decide whether ROCNY constituted a labor organization under the National Labor Relations Act.
