Facts
Banks (defendant) borrowed a horse from another person in order to carry a child to a nearby doctor. After that purpose was complete, Banks took the horse in a different direction. When someone offered to buy the horse, Banks agreed and sold it. Banks was tried and convicted of horse stealing. Banks appealed.
