Facts
Allison (defendant) was part of a conspiracy to make counterfeit American Express cards. To facilitate the conspiracy, Joan Ojomo, an American Express employee, accessed computer files and accounts that she was not authorized to access. Allison was indicted for his role in the conspiracy in the United States but was found in the United Kingdom. The United States sought to have Allison extradited from the United Kingdom to the United States for trial. Allison brought habeas corpus proceedings, arguing that the alleged computer crime was not an extradition crime under the Extradition Act 1989. The divisional court ruled in Allison’s favor, and the government appealed.
