Facts
A man in Newton Abbott contacted Turvey (defendant) that if he would steal table knives, spoons, and other items from his employer, the Minister of Works, the man would pay for them. Turvey relayed this information to a man named Ward who thereafter informed his supervisors, the individuals who were actually in control of the property to be stolen. The officials at the Ministry of Works instructed Ward to take the property and hand it over to Turvey, which he did. Turvey was charged with, and convicted of, larceny and he appealed.
