Facts
Thomas Rexford (Mr. Rexford) (plaintiff) and Sandra Rexford (Mrs. Rexford) (defendant) were long-term residents of Alaska. Mrs. Rexford moved to California and took the couple’s two children with her without Mr. Rexford’s consent. Eight days after arriving in California, Mrs. Rexford filed a petition in California state court for legal separation and custody. Mr. Rexford opposed the custody request, and the California court awarded temporary custody to Mrs. Rexford. The court also ordered the California probation department to conduct an investigation to assist the court in deciding which parent should have permanent custody. The probation department interviewed Mr. and Mrs. Rexford, the children, the children’s doctors, and others and compiled an extensive report. Mr. Rexford sued for divorce and custody in Alaska state court. The Alaska court ordered a stay of Mr. Rexford’s case pending the outcome of the California custody proceeding. Mr. Rexford appealed.
