Facts
Humberto Reyes (plaintiff) sued his employer, Aqua Life Corporation (defendant), for failing to pay him overtime wages as mandated by the Fair Labor Standards Act (FLSA). Aqua Life’s vice president, Mr. Ibarra, testified that based on his research into an exception to the FLSA, he believed the requirement of overtime pay did not apply to Reyes. However, Ibarra also testified that prior to Reyes’s suit, he was unaware of the FLSA’s existence. A jury awarded Reyes the overtime wages that had not been paid to him in the amount of $14,770. However, a district court judge declined to award liquidated damages as required for violations of the FLSA. The amount of liquidated damages was generally equivalent to the value of the lost wages attributable to the violation Reyes appealed.
