Washington Court of Appeals
361 P.3d 260 (2015)
- Written by Sharon Feldman, JD
Facts
Jay Rhodes (plaintiff) was attacked by a ram owned by his neighbor Rodney MacHugh (defendant). Rhodes was hospitalized for 16 days as a result of his injuries. Rhodes brought an action to hold MacHugh strictly liable for the harm caused by the ram because of the ram’s gender-based dangerousness. Rhodes did not allege that MacHugh was negligent or that the ram was abnormally dangerous for his breed. MacHugh’s motion for summary judgment was granted. Rhodes appealed.
