Facts
Christopher Kanoza (defendant), a minor, was the primary user of his mother’s Ford Escort. One night, Kanoza drove the Escort to a party, during which Kanoza let one of the other guests take his car out for a spin. After the guest returned the vehicle, Kanoza began playing a drinking game with 15-year-old Lindsay Duffy. Despite knowing that Duffy had been drinking, Kanoza did nothing to stop the girl from taking his keys, leaving the party, and driving off in the Escort. Two passengers were with Duffy when she crashed the Escort into another vehicle. One of the other vehicle’s passengers, Matthew Rice (plaintiff), sustained injuries in the crash and sued Kanoza for damages. Kanoza moved for summary judgment on the grounds that because he did not own the Escort, he could not be held liable for negligently entrusting the vehicle to Duffy. The trial court agreed and granted Kanoza’s motion. Rice appealed to the Ohio Court of Appeals.
