Facts
Robin Rider (defendant) was the step-father of a young girl. Shortly after his stepdaughter’s ninth birthday, Rider began sexually touching her and continued doing so until around the time of her twelfth birthday. In one instance, Rider sat next to her on the couch and showed her a pornographic movie. While she was watching the movie, Rider forced his hand onto her genitals. Shortly thereafter, Rider touched her genitals with his mouth and then had her touch his genitals with her mouth. After these incidents occurred, Rider would apologize to his stepdaughter and tell her it would not happen again. Rider was eventually charged with sexual abuse in the first degree and sodomy in the first degree. At trial, Rider’s stepdaughter testified that she considered Rider like a father and liked the way he treated her. Rider’s stepdaughter also testified that she knew his behavior was wrong but had gone along with it because she thought if she stopped, he would stop treating her well. Rider was convicted of both counts and subsequently appealed his conviction.
