Facts
The European Community (plaintiff) brought a civil suit against RJR Nabisco, Inc., and others (defendants) in the United States District Court for the Eastern District of New York, alleging a violation of the Racketeer Influenced and Corrupt Organizations (RICO) Act. Specifically, the European Community alleged that international drug traffickers smuggled drugs into Europe and that the proceeds from the drug sales were used to import into Europe large shipments of RJR cigarettes. RJR claimed that the RICO Act did not apply extraterritorially. The United States Supreme Court granted certiorari.
