Facts

Anthony Roberson (defendant) was charged with aggravated sexual assault. At trial, the prosecution (plaintiff) introduced DNA evidence linking Roberson to the crime. Expert witnesses testified to how rare Roberson’s particular DNA profile was in the general population. There was no other circumstantial evidence linking Roberson to the crime. Roberson was convicted, and he appealed. Roberson argued that DNA evidence alone was not enough to conclusively establish that he was the perpetrator. Roberson argued that DNA was a tool of probability in that it could eliminate a potential suspect but could not alone establish a suspect as the perpetrator beyond a reasonable doubt.
