Facts
Roberts (plaintiff) brought suit against Ring (defendant) on behalf of his minor son, John Roberts. Ring, a seventy-seven year old man with hearing and sight disabilities, was driving his car down a busy street. The car was obstructed by a buggy. John Roberts ran out from behind the buggy and in front of Ring’s car while the car was traveling four to five miles per hour. Ring saw John Roberts, but failed to stop his car. Ring struck the boy with his car, and John Roberts suffered injuries. The trial court held for Ring, and Roberts appealed.
