Facts
State Farm Fire and Casualty Company (State Farm) (defendant) insured Donald Roberts (plaintiff) under a homeowner’s policy that (1) excluded coverage for insect damage and (2) provided coverage for losses ensuing from an excluded event unless the ensuing event itself was excluded from coverage. Marring and settling were among the many exclusions that the policy applied to ensuing events. When Roberts discovered bees in his attic, he paid out of pocket for the costs of exterminating the pests. However, when the vacated beehive began leaking honey into Roberts’s dining room, Roberts filed a claim against his policy for the cost of repairing the leakage. State Farm denied coverage. Roberts sued. The trial court granted State Farm’s motion for summary judgment. An intermediate court affirmed that judgment on appeal. Roberts appealed to the Arizona Supreme Court.
