Facts
Pioche, Bayerque & Co. (Pioche) (defendant) dug a hole in the sidewalk in front of its property. Pioche left the hole uncovered, and Robinson (plaintiff) fell into it. Robinson brought suit against Pioche for damages. The trial court held for Pioche on the ground that Robinson was comparatively negligent due to his extreme intoxication. Robinson appealed.
