Facts

Helmerich & Payne, Inc. (Helmerich) (defendant) leased land from Rock Island Improvement Company (Rock Island) (plaintiff) in order to mine for coal. The lease included a reclamation clause, which provided that Helmerich was to bear the cost of reclamation after the coal mining was completed or abandoned. The land was ultimately not reclaimed, and Rock Island brought suit against Helmerich for breach of contract. Rock Island sought damages representing the cost of reclamation, which would have cost $375,000.00. Helmerich argued that the proper measure of damages was the diminution in market value of the land, which the parties stipulated was $6,797.00. The jury awarded Rock Island $375,000.00.
