Rocky Mountain Gun Owners v. Polis
Colorado Supreme Court
467 P.3d 314 (2020)

- Written by Sean Carroll, JD
Facts
In response to mass shootings in Colorado, the Colorado legislature passed a bill prohibiting the sale and possession of large-capacity magazines. Rocky Mountain Gun Owners (Rocky Mountain) (plaintiff) filed suit, challenging the law as a violation of the right to bear arms in self-defense under the Colorado Constitution. Rocky Mountain did not claim that the new law violated the Second Amendment to the U.S. Constitution. The state (defendant) presented evidence that large-capacity magazines in mass shootings increased the number of people shot and increased the number of deaths among people shot.
