Facts
Jane Roe (plaintiff) was a former employee of an escort service. Roe was interested in returning to her career as a prostitute but refrained out of fear of prosecution. Roe sued Robert Butterworth (defendant), Florida’s attorney general, contending that Chapter 796 of the Florida Statutes, which criminalized prostitution, violated her fundamental right to privacy, which she contended included her right to control her reproductive organs. Roe moved for summary judgment.
